What Is Conveyancing?

Conveyancing is the legal process of transferring property ownership from one person to another. It sounds simple โ€” but between contracts, searches, special conditions, finance clauses, building inspections, and settlement coordination, there are dozens of places where things can go wrong. This guide walks you through every stage for both buyers and sellers, so you know what to expect, when to act, and who to call.

Before you sign
Engage a conveyancer BEFORE you make an offer
Not after. A good conveyancer reviews the contract and searches before you commit. Many buyers leave this too late and sign something they later regret.
Order a contract review
Your conveyancer reads every special condition, checks sunset clauses, verifies inclusions, and flags anything unusual. This costs $300โ€“600 and is the best insurance you can buy.
Request the Section 32 / Vendor Statement / Form 1
This document tells you what the seller must disclose: easements, planning restrictions, outgoings, building permits, owners corporation info. Never sign without reading it.
Arrange your building and pest inspection
For houses: building + pest. For units: strata report. Do this during the cooling-off period or before auction. Budget $400โ€“800.

Exchange to settlement
Exchange contracts and pay the deposit
Usually 5โ€“10% held in trust. Your conveyancer lodges the contract with the state titles office. You are now legally committed โ€” cooling-off applies in most states (except auctions).
Your conveyancer runs searches
Title search, planning certificates, drainage diagrams, council rates, water rates, land tax. These confirm what you are actually buying and what debts come with it.
Formal finance approval
Pre-approval is not enough. Your lender values the property and issues unconditional approval. Do not assume โ€” confirm in writing with your broker.
Arrange building insurance from exchange
Risk passes to you at exchange in most states (not settlement). Insure the property from the moment contracts are exchanged, not when you get the keys.
Final inspection
Walk through 24โ€“48 hours before settlement. Check appliances, fixtures, inclusions list, and that no damage has occurred since you last saw it. Take photos.

Settlement day
Funds transfer
Your lender transfers the loan amount. You transfer the balance (deposit + remaining funds minus deposit already paid). Your conveyancer handles the paperwork.
Title transfer
The property title is transferred to your name at the state titles office. You now legally own it. This can take hours to register โ€” keys are usually released after confirmation.
Collect the keys
From the agent or vendor. Update utilities, mail redirection, insurance details, and change the locks. You are home.
